Should cohabitants who separate, or when one cohabitee passes away without a will, be protected by the same, or similar rights as those in a marriage?
Current proposals for reform seek to tackle one of the family law’s most difficult questions: considering the rights of those who cohabit as de facto couples without seeking marriage or civil partnership.
The proposed reforms would introduce a new, but deliberately narrower, statutory framework for financial provision. This talk will unpack the principles driving this reform, for better or worse, and look at the practical challenges that implementation may present for lawyers and clients alike.
