JUDGMENT HANDED DOWN IN HIGH COURT APPLICATION TO DISPENSE WITH SERVICE ON A PARENT IN FAMILY PROCEEDINGS

Fergal Allen and Janice Wills, members of 18 St John Street’s Family Department, appeared in the High Court recently in a case which concerned the principles to be applied when determining an application to dispense with service on a parent in family proceedings.

Fergal Allen appeared for the applicant and Janice Wills for the child in the High Court before Mr Justice MacDonald.

The court conducted a comprehensive analysis of the principles to be applied when determining an application to dispense with service on a parent in family proceedings.

Further, the court confirmed that in such applications consideration should be given to inviting the Attorney General to intervene on behalf of the absent parent.
