The key issue for the court to decide was whether DPW could be considered a “Defendant” for the purposes of seeking security for costs from the Claimant, Soprim. The court considered a body of case law about what constitutes a “claim” and “Defendant” in such circumstances before rejecting the security application on both jurisdictional and discretionary grounds.
